Terms of Service

1. The Service
FormPing (“the Service”) automatically tests the lead-capture paths of websites you own or are authorized to manage — contact forms, phone links, booking flows, and call-to-action buttons — and reports to you when a path fails. By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old and able to form a binding contract. The Service is offered to businesses worldwide except where prohibited by applicable law. The Service is designed for websites operating in North America and Europe; websites targeting mainland China are not supported.
3. Domain ownership and authorization — the core rule
You may only add a domain to the Service if you own it, or if you have express written authorization from the owner to run automated tests against it. Digital agencies adding client domains represent and warrant that they hold such authorization.
To enforce this, the Service requires domain ownership verification (DNS TXT record, file at the domain root, or meta tag) before any test is performed. You will not attempt to verify domains you do not own or control. We may refuse, suspend, or revoke verification of any domain at our discretion, and we do not perform any request against an unverified domain.
4. What our tests do — and deliberately don't do
Our tests submit synthetic, clearly labeled test data (for example qa-test-xxxx@formping.io) through your public-facing forms, follow phone and booking links, and record whether the path completes. Tests:
- never complete a real purchase, booking, or appointment;
- never access pages behind a login;
- never collect, store, or process data submitted by your real visitors;
- discard all synthetic test data immediately after each run.
You acknowledge that automated requests will be made to your verified domains and that notification emails labeled as tests will be generated in your own systems (e.g. your form notification inbox) as part of the Service.
5. Acceptable use
You agree NOT to use the Service to:
- test any domain you do not own or lack written authorization for;
- generate abusive traffic, load-test, or interfere with any third party's systems;
- probe, scan, or exploit websites other than your verified domains;
- reverse-engineer the Service, or use it to build a competing service;
- violate any applicable law, including computer-misuse and anti-spam laws.
Violation of this section is grounds for immediate termination without refund, and we will cooperate with lawful requests from affected parties and authorities.
6. Accounts and security
You are responsible for everything that happens under your account. Notify us immediately at support@formping.io if you suspect unauthorized use.
7. Subscriptions, billing, and refunds
Paid plans are billed monthly in advance through our merchant of record, Creem, which acts as the seller of record for tax purposes. You authorize recurring charges until you cancel. You can cancel anytime; access continues until the end of the current billing period.
Refund policy: if the Service hasn't worked for you, email us within 14 days of your first paid charge and we will refund it, no questions asked. Refund requests after 14 days are considered case by case. We may change plan prices with at least 30 days' notice; changes apply from your next renewal.
8. Service level and changes
The Service is provided on a best-efforts basis; we do not warrant uninterrupted or error-free operation, and scheduled maintenance may cause gaps in monitoring. We may add, change, or remove features; material reductions to a paid plan you are on will be notified at least 30 days in advance.
9. Indemnification
You agree to indemnify and hold harmless the operator of the Service from any claim, damage, loss, or expense (including reasonable legal fees) arising from: (a) your violation of these Terms, including the domain authorization requirement in Section 3; (b) your testing of domains without ownership or written authorization; or (c) your violation of any third party's rights or any applicable law.
10. Limitation of liability
To the maximum extent permitted by law, the Service is provided “as is” and our aggregate liability for any claim is limited to the amounts you paid us in the 12 months preceding the claim. We are not liable for lost profits, lost leads, lost revenue, or indirect or consequential damages. Nothing in these Terms limits liability that cannot be limited by law.
11. Termination
You may delete your account at any time. We may suspend or terminate accounts that breach these Terms — in particular Section 3 or 5 — immediately and without refund. Upon termination your data is deleted per our Privacy Policy, except records we must retain by law.
12. Governing law and disputes
These Terms are governed by the laws of the People's Republic of China, excluding conflict-of-law rules. Disputes will be resolved in the courts of the place where the seller is domiciled, unless mandatory consumer law gives you other rights.
13. Changes to these Terms
We may update these Terms from time to time. For material changes we will notify you by email at least 14 days in advance. Continued use after the effective date constitutes acceptance.
